By accessing or using our website and services, you agree to be bound by these terms and conditions, which we may update from time to time without prior notice. You can review the most current version of the TOU at any time on our website. Continued use of our services after any such changes constitutes your acceptance of the new terms.

DESCRIPTION OF SERVICE

This includes unrestricted access to the current GovernmentBidders.com site, daily email reports, government opportunities, vendor profiles, and special content features. Unless stated otherwise, any new features that enhance the current service shall also be subject to the TOU. The Service is provided "AS-IS" and "AS AVAILABLE," and we assume no responsibility for the timeliness, deletion, mis-delivery, or failure to store any user communications or personalization settings.

Users are responsible for obtaining access to the Service, which may include third-party fees (such as Internet service provider or airtime charges). Users must provide and are responsible for all equipment necessary to access the Service.

MODIFICATIONS TO SERVICE

FEES AND PAYMENTS

GovernmentBidders.com charges fees for access to its subscription services. To use the Service, you must register and create an account. You agree to pay all fees and charges, including applicable taxes, incurred through your account at the rate in effect for the billing period in which such fees and charges are incurred. We reserve the right to change the amount or basis for determining any fees and to institute new fees upon prior notice to you.

To set up an account, you must provide valid credit card information. By submitting such information, you authorize GovernmentBidders.com to charge all fees incurred through your account to the credit card you designate. Fees will be charged at the time they are incurred, and charges are made automatically upon the due date unless the subscriber cancels the account beforehand.

If payment cannot be charged to your credit card or your payment is returned for any reason, including chargebacks, GovernmentBidders.com reserves the right to suspend or terminate your account and all its obligations under this Agreement. If you believe your account is no longer secure, promptly change your password and notify GovernmentBidders.com.

Disputed charges must be reported within 40 days of the billing date by contacting our customer support team.

REGISTRATION AND ACCOUNT CREATION

During registration, you are required to select a User ID and password and provide accurate registration information, which must be updated as necessary. You are responsible for maintaining the confidentiality of your password and all activities that occur under your account.

NON-TRANSFERABILITY OF SUBSCRIPTION

Your right to use this site is personal to you and cannot be transferred, sold, or assigned to a third party without our approval.

SUBSCRIPTION RENEWAL AND CANCELLATION

GovernmentBidders.com will automatically charge your account upon the renewal date based on your subscription plan. To discontinue the service, you must notify us before the subscription renewal date. If you cancel during the subscription period, no refund will be provided for the remaining portion of the subscription fee.

DISCLAIMER OF WARRANTIES

You expressly understand and agree that:

  • Your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis. GovernmentBidders.com disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • GovernmentBidders.com makes no warranty that the service will meet your requirements, be uninterrupted, timely, secure, or error-free; that the results obtained from using the service will be accurate or reliable; or that any errors in the software will be corrected.

  • No advice or information, whether oral or written, obtained by you from GovernmentBidders.com shall create any warranty not expressly stated in the TOU.

LIMITATION OF LIABILITY

GovernmentBidders.com shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (even if GovernmentBidders.com has been advised of the possibility of such damages), resulting from:

NON-WAIVER

The failure of GovernmentBidders.com to exercise or enforce any right or provision of the TOU shall not constitute a waiver of such right or provision. If any provision of the TOU is found by a court of competent jurisdiction to be invalid, the parties agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOU remain in full force and effect. VIOLATIONS

Please report any violations of the TOU to our customer support team.

RESTRICTIONS ON USE

SEVERABILITY

ENTIRE AGREEMENT

This Agreement, along with any other terms and conditions of service on https://www.governmentbidders.com, constitutes the entire agreement between you and GovernmentBidders.com and governs your use of the Service.

REFUSAL OR DISCONTINUANCE OF SERVICE

GovernmentBidders.com reserves the right to refuse or discontinue service to any user for non-compliance with these Terms of Service.
