LEGAL NOTICE TO BIDDERS
Sealed Bids will be received by the Town Engineer of the Town of Morristown, in the County of Morris, State of New Jersey,
Municipal Building, 200 South Street, Second Floor, Room 233, Morristown, New Jersey, 07960, on AUGUST 11, 2026 at 10:00
a.m., prevailing time for the furnishing of the following:
TENNIS COURT RECONSTRUCTION AT JACOB FORD PARK
This project consists of (between base bid and alternate bid items) the construction of one concrete tennis court with an
acrylic colorcoat surfacing system and chain-link fencing around the new court. The major items of construction in the base
bid and alternate bids are generally as follows: Excavation, Unclassified – 687 C.Y., Concrete Surface Course, 8" Thick, Fiber-
Reinforced – 1 L.S., Furnish and Install 4" Corrugated Double-Wall HDPE Perforated Drain Pipe – 621 L.F., PVC Cleanout with
Corrugated Pipe Adapter – 4 Units, Riprap Outlet Protection, 8" Thick (D50 = 4" to 6") – 1 L.S., Chain-Link Fence, Black
Polyolefin-Coated Steel, 12' High – 383 L.F., Gate, Chain-link, Black Polyolefin-Coated Steel, 3.5' Wide x 7' High – 2 Units,
Concrete Sidewalk, 5" Thick – 6 S.Y., Furnish and Install Laykold Masters Color [or Approved Equal] Acrylic Tennis Court
Athletic Surfacing System – 1 L.S., Furnish and Install Tennis Net System, Complete with Posts, Footings, Center Anchor, and
Net (Douglas Sports TN-45 or Approved Equal) – 1 L.S., Retaining Wall, Quarry Boulder, 1' to 6' High x 2.5' to 3' Thick – 310
S.F.
Specifications for the above may be examined in the Office of the Town Engineer, Room 233, 200 South Street, Morristown,
New Jersey, between the hours of 8:30 am and 4:20 pm, Monday through Friday. Any person, firm, or corporation desiring a
copy of the Specification Documents may obtain such from the Office of the Town Engineer.
Any reference in the Bid specification documents to the terms “Proposal” or “Proposer” shall be construed to have the same
meaning as the terms “Bid” or “Bidder” pursuant to the Local Public Contracts Law.
Bidders must use the prepared Bid Forms. Each bid must be enclosed in a sealed envelope addressed to the Town Engineer,
Town of Morristown, marked on the outside “TENNIS COURT RECONSTRUCTION AT JACOB FORD PARK” and delivered on or
before the hour set forth above. Bid opening will be held in Meeting Room 201, at 200 South Street, Morristown, N.J. at 10:00
a.m. NO BIDS WILL BE ACCEPTED AFTER THIS TIME. The Town of Morristown will not assume responsibility for bids forwarded
by mail or delivery service. The Town of Morristown reserves the right to award the contract to the lowest responsible bidder.
The successful bidder will be required to execute the contract and file a bond within (10) ten days after award of the project
and submit any other necessary documentation.
Bids must be accompanied by a bid guarantee in the form of a certified check, bid bond, or cashier’s check in the amount of
ten percent (10%) of the total amount bid, (bid bond amount not to exceed $20,000.00), and made payable to the order of
the Town of Morristown, together with a “Consent of Surety” from a surety company authorized to do business in New Jersey
stating that it will provide the contractor with a bond in such amount as requested in the advertisement or specifications.
The guarantee of the successful bidder will be returned upon execution of the contract. All guarantees of the unsuccessful
bidders will be returned upon award of contract to the successful bidder.
Bidders (and Bidder’s subcontractors, if any) should submit a Business Registration Certificate issued by the New Jersey
Department of the Treasury, Division of Revenue, in accordance with the requirements of P.L. 2009, c. 315.
Bidders must be registered pursuant to The Public Works Contractor Registration Act, N.J.S.A. 34:11-56.48, et seq., (the
“PWCRA”) at the time that the bid is made and must submit a copy of the certificate of registration with the bid form. All
subcontractors listed in the bid must also be registered pursuant to the PWCRA at the time the bid is submitted. After the bid
is made and prior to the awarding of the contract, the successful bidder must submit to the Town copies of the certificates
of registration for all subcontractors listed in the bid.
Bidding information contained in this Bid should be clear and not subject to qualifications, deletions, erasures, or other
markings that create any doubt as to its meaning. Bidders should make sure that the Bid Form is signed by a duly authorized
person on behalf of the bidder and that the bid is responsive. Bidders can determine the responsiveness of their bid by reading
“General Instructions for Bidders” and the “Bid Document Submission Checklist”. INSTRUCTIONS MUST BE FOLLOWED
EXACTLY OR THE BID MAY BE DECLARED NON-RESPONSIVE.
The right to reject any and all bids and to waive any informality in any bid is reserved if such an action is not detrimental to
the interest of the Town of Morristown.
Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27-1 et seq., which pertains
to "non-discrimination" and "affirmative action" and N.J.S.A. 52:2524.2 (P.L. 1977, c. 33, as amended by P.L. 2016, c. 43),
which refers to the statement of corporation ownership.
Attention is called to the fact that the contractor must ensure that employees and applicants for employment are not
discriminated against because of their race, creed, color, sex, or national origin and to the greatest extent possible,
opportunity for training and employment shall be given to lower-income residents of the project area and that, when
possible, contracts shall be awarded to business concerns owned by area residents.
