TELECOMMUNICATIONS FRANCHISE APPLICATION
Sealed proposals including this Telecommunications Franchise Application and all submittals must be
received no later than 10:00 a.m., local time, on the bid opening date. Proposals shall be submitted in
both hard copy and digital format, loaded onto a USB or external drive, and included in the sealed
proposal packet. Sealed proposals should be delivered to the City Clerk, Lindsay Parish, 300 South 5th
Street, P.O. Box 2267, Paducah, KY 42002-2267.

REQUIRED ATTACHMENTS AND SUBMITTALS
ATTACHMENTS: Please clearly label each document “Attachment A,” “Attachment B,” etc.
A.
Detailed narrative description of the Applicant’s proposed and/or existing Telecommunications
System design.
B.
Brief statement setting forth a description of all the types of Telecommunications Services
proposed or currently being offered.
C.
Inventory disclosing the ownership of the Facilities to be used in rendering the
Telecommunications Services. The Applicant should identify all parent companies, subsidiary
companies, or sister companies of the Applicant. Also, please note whether Applicant will use its
Facilities to carry traffic or information for:

telecommunications system was completed.

Technical description of the type of Communication System proposed/operated by the Applicant
and Applicant’s plan for the installation of the Telecommunications System, if applicable.
Telecommunications System designs are to be submitted in bullet format detailing equipment
start point, routes, and end point location, accompanied by network routing maps(s). This should
also include: An appropriate scale map to show the route that the telecommunications
infrastructure takes and/or will take through the City.
F.
Statement from the Applicant’s senior technical staff member, or consultant, advising that the
Applicant’s planned Telecommunications System and operations thereof will meet or
currently does meet all the requirements set forth in the City’s Telecommunications Franchise
Ordinance. If the existing system does not meet all of the requirements set forth in the City’s
Telecommunications Franchise Ordinance, please provide a plan for how the system will come
into compliance and an associated timeline.

A copy of the Applicant’s certificate of authority from the PSC where the Applicant is lawfully
required to have such certificate.
H.
Copies of all insurance policies or certificates required under the City’s Telecommunications
Franchise Ordinance.
I.
A statement signed by the Applicant indicating that the Applicant agrees to be bound by all

provisions of the City’s Telecommunications Ordinance and its franchise and agrees to obtain all
applicable permits and authorizations prior to constructing, installing, or operating a system in
the right-of-way.
J.
A statement signed by the Applicant indicating that the Applicant is registered as a member of
Kentucky 811 (commonly referred to as “Call Before You Dig”) and Applicant that agrees to
contact Kentucky 811 before performing any excavation in the City.
K.
An estimate of the Applicant’s anticipated annual Gross Revenues (as such term is defined in the
City’s Telecommunications Franchise Ordinance) for the first year of the franchise.
SUBMITTALS
A.
Supplementary, additional or other information that the Applicant deems reasonable for
consideration may be submitted at the same time as its application but must be separately
bound and clearly identified as “Supplemental Applicant Materials.” The City may, at its
discretion, consider such additional information as part of the application.
B.
Application shall be accompanied by a non-refundable application fee of $5,000 payable to the
“City of Paducah” via check or money order.
C.
If Applicant does not already hold a franchise within the territorial limits of the City of Paducah
sufficient to render the Telecommunications Services required by the Telecommunications
Ordinance, Application shall be accompanied by cash or a certified check drawn on a bank of the
Commonwealth of Kentucky, or a national bank, equal to the lesser of five percent (5%) of the
fair estimated cost of the Telecommunications System required to render the
Telecommunications Service or $100,000. Applicant shall also include such documentation as is
necessary to support the Applicant’s determination of the fair estimated cost of the
Telecommunications System and compliance with all applicable state, federal and local statutes,
ordinances and regulations.
DIGITAL SUBMITTAL REQUIREMENTS
All attachments and submittals listed above must also be submitted digitally utilizing a USB drive or external drive
included in the sealed proposal packet. PDF format is acceptable for submittals.
The City reserves the right to require such supplementary, additional or other
information that it deems reasonably necessary to award or deny a franchise.

AFFIDAVIT
I, THE UNDERSIGNED, HAVE COMPLETED THE FOREGOING APPLICATION AND KNOW OF ITS
CONTENTS OF MY OWN KNOWLEDGE. I DECLARE UNDER PENALTY OF PERJURY UNDER THE LAWS
OF THE COMMONWEALTH OF KENTUCKY THAT THE FOREGOING IS TRUE AND ACCURATE TO THE
BEST OF MY KNOWLEDGE. APPLICANT FURTHER ACKNOWLEDGES AND CERTIFIES THAT IT SHALL:
(1) BE RESPONSIBLE TO CERTIFY TO THE CITY OF PADUCAH ANY MATERIAL CHANGES TO THE
INFORMATION PROVIDED IN THE COMPLETED APPLICATION DURING THE TERM OF ANY
FRANCHISE AND (2) APPLY FOR AN ENCROACHMENT PERMIT AND/OR STREET CUT PERMIT WITH
THE CITY BEFORE ACTUAL CONSTRUCTION BEGINS.
