Notice & Invitation to Bid
Eagle Trace Stormwater Management Pond
Sealed bids are invited for the Eagle Trace Stormwater Management Pond project.
The project includes associated grading and drainage improvements, storm
infrastructure replacement to include outlet structure and the outfall pipe, forebay
creation, erosion and sediment control, landscaping and other site improvements as
described in the specifications and on the drawings.
The work is located in the Eagle Trace Subdivision at 0 Norman Drive, Pencader
Hundred, Newark, Delaware
Sealed bids addressed to the New Castle County Purchasing Division will be
received by the Purchasing Division, New Castle County Government Center, 87
Reads Way, New Castle, DE, 19720, telephone (302)395-5250 until 8-25-2026
when they will be opened and read publicly.
Bid envelopes shall carry a clear notation " Eagle Trace Stormwater
Management Pond," Contract 2026-05, Bid # 26-2605. Plans and specifications
may be obtained in the William J. Conner Building, 187-A Old Churchmans Road,
New Castle, DE, 19720, on and after July 17, 2026 upon payment of $25.00 (non-
refundable.) Digital plans are provided without fee. Please call (302) 395-5749 or

Bids shall be accompanied by a bidder’s bond, certified or cashiers' check in an
amount equal to 10% of the bid price, payable to New Castle County and
conditioned to be forfeited to said County for failure to enter into a contract, if
awarded. The bid bond shall be an original document containing original signatures,
and original seals shall be attached if the corporate surety and/or bidder have
corporate seals.
Awards, if any, will be made to the lowest and best responsible bidder. The County
reserves the right to reject all bids and to waive minor irregularities. The successful
Bidder will be required to give bond of a surety company, acceptable to the County,
and licensed to do business in the State of Delaware, in the amount of the contract
price. Please see New Castle County Code Sect. 2.05.303(D) for additional
requirements and information.
MANDATORY PREBID MEETING
There will be a mandatory pre-bid meeting for prime bidders at 9:00 a.m. on August 5, 2026 in the
William J. Conner Building, 187-A Old Churchmans Road, New Castle DE 19720. Interested bidders
will also be able to attend via a Teams meeting invitation for virtual attendance.

QUALIFICATION
New Castle County will only accept bids from contractors prequalified with the County in the category
“B,” Site Work or “C” Stormwater Practice. Qualification forms are available from the Public Works
Contracts Officer in the William J. Conner Building, telephone 302-395-5727 or by email
briana.nelson@newcastlede.gov.
ALCOHOL & DRUG TESTING
New Castle County Code, Section 2.05.305 requires contractors and subcontractors who work
pursuant to a Public Works contract to implement a mandatory alcohol & drug testing program for
their employees. Included in the specifications for this project is an affidavit for certifying compliance
with the Code requirements. This affidavit must be executed and submitted with the bid. Failure to
submit the affidavit by that time shall result in the County’s inability to consider your bid for award.
Forms submitted by facsimile will not be accepted.
SMALL BUSINESS ENTERPRISE PROGRAM
This contract will be awarded pursuant to New Castle County’s Small Business Enterprise (“SBE”)
Program. All bidders must comply with the SBE Program by either (i) satisfying the Project Goal
through utilization of an SBE to perform work under the contract; or (ii) demonstrate their good faith
effort to obtain SBE participation in the contract. SBE Program forms are available on New Castle
County’s website and are included in the specification. These forms must be included with your bid.

PREVAILING WAGES
The payment of prevailing wages as determined by the State of Delaware Department of Labor to all
mechanics and laborers working on the project is required. The schedule of rates applicable to this
project is included in the specification.
CONTRACTOR REGISTRATION ACT
The contractor registration act, as codified in 19 DEL. C. {{3601 ET SEQ. requires all contractors
performing construction to register with the Department of Labor. Additionally, it requires contractors
to have Delaware Workers’ Compensation Insurance where required, compliance with labor laws and
proof of state business license. The Delaware Department oof Labor’s Office of Contractor
Registration is responsible for enforcement of the requirements of the contractor Registration Act. If
