DEP intends to enter into a Sole Source Agreement with Emerson Process Management Power & Water Solutions, Inc., to furnish labor, parts, materials, and equipment necessary for the service and repair of the Distributed Control System (DCS) at the Hunts Point WRRF, Bowery Bay WRRF and CFS Paerdegat.
The Bureau of Wastewater Treatment (BWT) has Emerson Distributed Control System (DCS) at Hunts Point WRRF, Bowery Bay WRRF and CFS Paerdegat and is in place to monitor and control critical processes and equipment that treat wastewater at these facilities. Distributed Control System (DCS) is a computerized control system for plant process with various complex loops. DCS manages complex processes by collecting information from field devices (Sensors and gauges), processes it internally and controls/automates the output devices. DCS increases reliability by distributing control process across various nodes therefore negating possibility of large-scale failure.

GENERAL PROVISIONS
D-1.1
GENERAL DESCRIPTION OF THE WORK:
Emerson Process Management Power & Water Solutions, Inc. (hereinafter referred to
as “Emerson” and/or the “Contractor”) shall furnish labor, parts, materials, and
equipment necessary for the service and repair of the Distributed Control System
(DCS) at the Hunts Point Wastewater Resource Recovery Facility (WRRF), Bowery
Bay WRRF, and Collection Facility South (CFS) Paerdegat. The Contractor shall be
paid in accordance with Exhibit A and this Contract. All parts and materials shall be
supplied from the individual facility’s existing on-site spare parts inventory. Where
not available, such parts or material shall be purchased from the Parts & Material
Allowance noted in Exhibit A.

LOCATION OF WORK:
The locations of the Work to be performed under this Contract are at the Hunts Point
WRRF, 1386 Ryawa Avenue, Bronx, NY 10474; Bowery Bay WRRF, 4301 Berrian
Boulevard., Queens, NY 11105; CFS Paerdegat, 1887 Ralph Avenue, Brooklyn, NY
11234.

NOTIFICATION OF START OF WORK/ DAILY SIGN-IN AND SIGN-OUT:
Unless otherwise specified in Division No. 2 of the Specifications, the Contractor shall
notify the Project Manager at least forty-eight (48) hours in advance of its intention to start
Work. Should the Work be halted for any reason, the Contractor is also required to notify
the Project Manager at least forty-eight (48) hours before its intention to resume Work.
At the start of each Workday, the Contractor’s representative (i.e., foreman, supervisor,
etc.) shall report to the WRRF/CFS Office to sign in and provide the number of workers,
including subcontractor workers, on Site that day. At the end of the Work day, The
Contractor’s representative shall report to the WRRF/CFS Office and sign out. Copies of
the WRRF/CFS sign-in sheets must be submitted with each partial payment request.
Failure to comply with these requirements will be reflected in the Contractor’s
performance evaluation.
All Contractor personnel at the Work Site, including subcontractors, shall wear a photo
identification that indicates the company name, and the employee’s name. The photo
identification must be durable, retain legibility, and be clearly displayed at all times when
at the Work Site.

D-1.6 SUBMITTALS FOR APPROVAL:
Upon request by DEP, the Contractor shall submit, for approval by the Project Manager,
detailed information (shop drawings, catalog cuts, etc.) on the equipment to be installed or
other Work to be performed under this Contract prior to the start of Work. If the shop
drawings contain any deviations from the Contract Drawings or Specifications, the
Contractor shall make specific mention of the deviations in its letter of transmittal. If the
Contractor proposes a substitution of the manufacturer or to furnish a substitute item,
material or equipment (i.e., the submission of a proposed “or-equal”), it shall make a
written application to the Project Manager for acceptance by providing sufficient
information. Such application shall be subject to the following requirements:
A. The Project Manager will be the sole judge as to the type, function and quality of
any such substitute material or manufacturer and his or her decision shall be final.
The Project Manager is not required to justify to the Contractor the basis for his/her
decision.
B. Acceptance by the Project Manager of a substitute item or manufacturer shall not
relieve the Contractor of the responsibility of full compliance with the Contract
Documents.
C. Only material and equipment that are products of a reputable manufacturer having
a facility of ample capacity and are of a type which has been satisfactorily used
elsewhere for the same purpose for at least five (5) years shall be used. The
Contractor shall provide a list of supplied customers upon request by DEP.
Should the Contractor submit for approval of proposed substitute equipment that requires
modifications to structure(s), existing equipment, piping, electrical conduit, wires and
appurtenances, layout, etc., details of the proposed modifications shall be provided. If such
proposed equipment and modifications are accepted, the Contractor shall perform all Work
necessary to make such modifications, at no additional cost to DEP.
The Contractor is advised that DEP’s time for review of submittals has already been
incorporated into the Contract duration and additional time to complete the Work will not
be granted.
D-1.7 DISMANTLING AND REASSEMBLING OF EXISTING EQUIPMENT:
Wherever required in order to install new parts, repair old parts, and/or install repaired or
usable old parts, the Contractor shall do all necessary dismantling of the equipment and
removal of parts to allow for performance of the Work as specified. All disturbed Work
shall be reassembled and left in first class working condition. During the course of
removing or altering existing equipment to perform the Work, the Contractor shall be
responsible for repairing or reinstalling the existing equipment (e.g., electrical conduit,
