The award will be based on an evaluation by the Project Team.

This is a two-contract award process, where PENTA will issue two separate contracts: a Preconstruction Contract and a Construction Contract. During Preconstruction Phase, the DB subcontractor will work with the PENTA|Gensler team to complete the design for his scope of work becoming the engineer of record for such work. The DB Subcontractor shall commit to a guaranteed maximum price (GMP) and to a schedule at 100% design development. The DB Subcontractor will be contractually required to hold his proposed construction cost during the construction phase, unless modified by change order.

Bidders acknowledge that the award of the construction contract is contingent upon the GC receiving a construction contract award from CSULB. Bidders also acknowledge that the award of a preconstruction contract does not guarantee the award of the construction contract.
